International conference “Judicial Enforcement Reform: Challenges and Prospects”

On September 24, 2009 the Commercial Law Center jointly with the Ministry of Justice of Ukraine held the International scientific-practical conference on the topic “Judicial enforcement reform: challenges and prospects”.

Among the conference participants were the Ukrainian parliamentarians, representatives of the government bodies of power and judicial system, scientists and leading experts in the sphere of law, foreign experts and mass media.

The plenary meetings were dedicated to the analysis of the current state of judicial enforcement in Ukraine and discussion of the European experience in reforming the judicial enforcement system, problematic issues of judicial enforcement and further ways for its reforming.

Mr. Hennadiy Stadnyk, Deputy Minister of Justice and the State Enforcement Service Department Director, thanked those present for the attention to the issues of judicial enforcement. He spoke about state priorities in improving the judicial enforcement system and presented the concept of introduction of private bailiffs’ service in Ukraine.

Ukrainian parliamentarian Mr. Yuriy Miroshnychenko presented to the conference participants the Draft Law of Ukraine “On Private Bailiffs”, of which he was the co-author. The Draft Law was registered with the Verkhovna Rada of Ukraine on 09.22.2009 at #5151. He also thanked CLC and the Ministry of Justice for their participation in the development of the above legislation, for long-lasting and fruitful cooperation in the law making area.

The conference participants discussed the current state and the strategy for further reforming of the judicial enforcement system. Speakers did not only touch on many important problems, but proposed constructive ways for their resolution.

In the result of this discussion there was reached an agreement on joint approach to determining further priorities in reforming the judicial enforcement system through establishing a private form of court decisions execution, improving judicial enforcement legislation and bringing into compliance the procedures of judicial enforcement and bankruptcy.

As a whole, the conference laid the foundation for further constructive changes and successful reforming of the judicial enforcement system, summarized the results of performed work and defined the directions for further reforming of judicial enforcement legislation.
