International conference “Arbitration Courts: Legislative, Institutional and Practical Aspects of Adjudication”

On July 28, 2010 CLC, the Union of Arbitration Judges of Ukraine, Arbitration Chamber of Ukraine and Association of Ukrainian Banks co-hosted an international conference “Arbitration Courts: Legislative, Institutional and Practical Aspects of Adjudication”.

Among the participants were members of the Parliament, representatives of the Ministry of Justice and other public agencies, the judiciary, academia and professional legal community, mass media and foreign experts. They gathered to analyze the issues, which hamper arbitration courts’ activities in Ukraine and to define possibilities for improvement based on the foreign experience.

Opening speeches were delivered by Ms. Valentyna Danishevska, CLC Director, Mr. Glib Krivenko, USAID and Mr. Oleksandr Sugonyako, UBA President.

Mr. Yuriy Prityka, Deputy Minister of Justice spoke about the position of the state regarding arbitration courts, expanding the application of arbitration courts proceedings to disputes resolution and raising awareness of legal community of the advantages and disadvantages of arbitration.

Ms. Olena Perepylynska, Law firm “Vasyl Kysil and Partners” spoke about functioning of the arbitration courts system in different countries and various models of arbitration in European countries. Mr. Arkadiusz Radwan, President of the Allerhanda Institute in Poland and Mr. Mikhail Morozov, Chair of the Siberian Court of Arbitration, shared the experience of Poland and Russia with their colleagues. Mr. Morozov paid attention to the absence of registration of arbitration courts and judges in Russia, as well as absence of requirements to the arbitration court judges. According to him, this resulted in appearance of a great number of courts, which exist only on paper. Moreover, there is no self regulation of arbitration courts in Russia, while in Ukraine this issue is being actively discussed.

In the course of the conference its participants also discussed the issues of co-existence of state courts and courts of arbitration; arbitration courts practice of commercial disputes resolution; arbiters’ professional standards and ethics; challenges to enforcing decisions of the courts of arbitration in Ukraine etc.

Summing up the conference results, Mr. Yury Mykhalski, Head of the Arbitration Chamber of Ukraine, expressed his gratitude to Ms. Valentyna Danishevska for her contribution to the arbitration courts development and awarded her with an honorary award “For Merits in Arbitration Courts Development in Ukraine”.
